Why have a Last Will?

  • To ensure you are deciding who will manage your assets and receive your estate after you pass away. If you do not have a Will, you run the risk of having the Courts decide how your estate will be distributed and who will be named beneficiaries of your estate.
  • Do you have children? If so, it is even more crucial to have a Will drafted as you will need to appoint a litigation guardian if both you and your partner pass away while having dependent children.

Power of Attorney – Personal Care and Property

A power of attorney is a legal document that gives someone you trust the right to make financial or health care decisions for you.

A Power of Attorney document is a crucial part of your estate planning needs. A Power of Attorney document is a written agreement in which you convey authority to another person to make medical of property decisions on your behalf. You should choose a person you trust to act as your power of attorney, such as:

  • a family member
  • spouse
  • long-time friend
 

Documents

The following are the 3 types of Ontario Power of Attorney Documents:

This document appoints an individual to make medical and health care decisions on your behalf while you are physically incapacitated.

This document appoints an individual to make financial decisions on your behalf and allows the appointed individual to act for you in all circumstances. You can specify if this document will be used only if you lose mental capacity or if you are away for a certain period of time. For example, if you are due to be away from the city when you need to sign a document or pay a bill, you can use this document to appoint someone to sign the documents on your behalf.

This document appoints an individual to make financial decisions on your behalf but immediately ceases to be effective if you lose mental capacity. Individuals like to use this document if they plan to be away from the city for a lengthy period of time and require someone to represent them while they are away.
